| POLICY NOTICE AND SCOPE
These Amenity Rules & Regulations (the “Amenity Rules”) are adopted by the Board of Directors of the Anneewakee Trails Property Owners Association, Inc. (the “Association”) under its authority in the Association’s Governing Documents, including the Declaration of Covenants, Conditions & Restrictions (the “CC&Rs”) and the Bylaws (Bylaws Section 3.18(f), authorizing the Board to make and amend rules and regulations). The Amenity Rules supplement, and are to be read together with, the Governing Documents. If any provision of the Amenity Rules conflicts with the Governing Documents, the Governing Documents control. Amenities Covered. The Amenity Rules apply to all Association amenities and facilities at Anneewakee Trails, including but not limited to the Clubhouse, the Pool (and Lazy River and Splash Pad), the Gym/Fitness Center, the Gazebo, all Courts (Basketball, Tennis, and Pickleball), the Park, and all other common amenities and facilities (collectively, the “Amenities”). Except where a specific provision states otherwise, every rule, conduct standard, access requirement, and enforcement procedure in this document applies to each of the Amenities. Who Is Bound. These rules apply uniformly to all homeowners, residents, registered household members, and guests, regardless of age. Adoption, Review & Effective Date. These Amenity Rules were approved for review and updating at the April 2025 meeting of the Board of Directors, and were adopted by Board Resolution approved December 15, 2025. The Amenity Rules are effective for the 2026 amenity season and supersede all prior versions. The Board may review, amend, or supplement these rules from time to time consistent with the Governing Documents. | SECTION 1 Digital Access PASS SYSTEM |
1.1 What Is the Digital Access Pass?
The Digital Access Pass (DAP) is an electronic credential that manages and verifies membership for access to all community amenities and events. All homeowners, residents, and authorized guests are required to hold a valid Digital Access Pass to access any amenity, including the Pool, Fitness Center, and all Courts. The DAP replaces all previous wristband and paper-based access systems.
1.2 How to Apply
Online Portal: Visit Portal to complete your application at any time from your phone or computer. You will need to create a login and password. to provide household information, submit photographs, and upload identification documents verifying residency.
Applications are processed during hours the Office is open ( Monday thru Friday). Processing times for applications differ based upon season.
Peak Season April thru July = 5-10 business days
Non Peak Season August thru March = 3-5 business days
Online Assistance: Call or Email the clubhouse for assistance with your DAP. The Property Management Team is available to share a variety or resources to assist you with completing your DAP.
Confirmation: Upon successful submission, you will receive a confirmation email. If no confirmation email is received within a few minutes, check your spam folder.
Application Updates: Applications can only be updated by emailing support [email protected] with your request for an update and the reason for the update.
1.3 Household Pass Allotment & Fees
Each household is entitled to passes based on the following schedule:

Member passes are issued to owners in the community and include 5 passes per household. The Board of Directors of Anneewakee Trails reserves the right to verify all pass requests to include requiring documentation to confirm residency. Households requiring passes for additional verified residents may obtain them at the published flat rate of $35.00 per pass, per year. Additional resident passes are issued upon verification of residency and are subject to approval.

1.4 Digital Pass and Access
All Homeowners and residents must have a Digital Access Pass to access amenities. If you do not wish to provide your photo, you may opt out, but will be required to provide a photo ID during each visit to the Amenities as well as the Digital Pass.
1.5 Pass Usage Requirements

- Your Digital Access Pass must be presented upon each and every entry to a community amenity.
- Passes are non-transferable. Sharing, lending, or allowing another individual to use your pass is strictly prohibited. Once you have set your 5 passes you must provide proof of a change. A household’s pass roster may be updated during the season to reflect a bona fide change in occupancy only (for example, a birth or adoption) . You may purchase additional passes for $35 for individuals residing in the household Only. Passes for those that do not reside in the house will be considered “guests”.
- Good Standing: Homeowners with outstanding dues, fees, or unresolved violations will not be permitted to access any amenity until all outstanding balances are paid in full and any violation is resolved.
- Allowing any individual to tailgate or piggyback through an access gate without presenting their own valid Digital Access Pass (DAP) may result in removal of the responsible individual and their guest(s) from the Amenity for the remainder of that day. Repeated occurrences may result in a longer suspension of the responsible homeowner’s amenity access privileges, imposed in accordance with the Enforcement Procedure (Bylaws Section 3.21) described in Section 7.
| SECTION 2- GUEST PASS POLICY |
Guests are welcome to enjoy community amenities when properly registered and accompanied by a resident homeowner. The following policy governs all guest access.
2.1 Guest Limits
- A maximum of three (3) registered guests are permitted per household per visit.
- Individuals who live within the Anneewakee Trails community are residents and not guests. All residents must register as community members. All individuals that so not live in the community and visiting must register as a guest.
- During periods of maximum occupancy, guest access to amenities may be temporarily limited at the discretion of the on-duty Ambassador/Security.
2.2 Guest Registration & Pass Advance Requirement
Because community amenity facilities operate on set hours and passes must be issued and verified in advance, the following registration timeline is required:

date of entry to ensure full access. The Association cannot guarantee same-day or walk-in guest pass issuance Please plan accordingly. * During Annual Community Registration this minimum may increase to 7 days. |
- Guest passes must be requested by the homeowner through the online portal.
- The homeowner must provide the guest’s full name, intended visit date(s), and relationship to the household.
- Passes may be issued digitally to the homeowner’s account or in person at the clubhouse.
- Guest passes are non-transferable and valid only for the registered guest and approved date(s).
2.3 Guest Entry Requirements

- All guests must present a valid government-issued photo ID upon entry and are allowed one visit per day.
- Guests must hold a valid Temporary Pass purchased in advance on entrance. Access will depend on ability to see payment and proper registration of the pass.
- Guests must be accompanied by their sponsoring member or approved designee for entry into the Pool and Fitness Center. Guests may not enter these facilities independently without the Sponsoring member or approved designee. Rules regarding access to the pool and fitness/gym area applicable.
- Upon entry, guests must check in with the on-duty Ambassador and present their Digital AccessPass or guest pass credential.
2.4 Guest Conduct
All guests are subject to the same rules, regulations, and conduct standards as community members. Violations by any guest may result in removal of the guest from the Amenity and may lead to suspension of the sponsoring homeowner’s amenity access privileges. Any such suspension is imposed in accordance with the Enforcement Procedure (Bylaws Section 3.21) described in Section 7.
| SECTION 3 POOL, LAZY RIVER & SPLASH PAD RULES |
| NO LIFEGUARD ON DUTY: Swimming is at your own risk. Parents and guardians are responsible for the safety of all persons in their care and at all times. |
3.1 Entry & Access
- All residents and guests must present a valid Digital AccessPass or approved guest credential upon entry.
- No one may enter the pool area outside of posted operating hours. Entering the pool area outside posted hours is a violation of these rules and may result in enforcement under Section 7; trespassing may also be reported to the proper authorities.” This states the fact and the provision without the adversarial tone
- No jumping, climbing, or vaulting over fences or gates.
- The pool area gate must never be held open for individuals who have not presented their own valid DAP.
- Ambassadors and Patrol Guards are provided with the right to view the interior contents of all gym bags, purses etc for anyone entering the pool area.
3.2 Attire & Hygiene
- Proper swimwear is required at all times. The following are strictly prohibited in the pool, lazy river, and splash pad: street clothes, basketball shorts, regular shorts or capris, cut-off jeans, denim of any kind, and underwear.
- All bathers must shower before entering the pool to remove sweat, dirt, oils, and personal care products. Shower facilities and lockers are available on-site.
- No swimming with open wounds, bandages, or any contagious skin conditions.
- All children who are not fully potty-trained must wear approved swim diapers. Standard disposable diapers and cloth diapers are not permitted in pools, the lazy river, or the splash pad under any circumstances.
- No person with a fever, cold, skin infection, eye infection, nose or throat infection, or any other communicable ailment may use any pool facility.
3.3 Safety Rules
- No running, pushing, or horseplay anywhere in the pool area.
- No diving or jumping into the pool. The pool is not designed for diving.
- No excessive splashing or disruptive water play that affects other bathers.
- No standing on or sitting on the shoulders of others.
- No hanging on lane dividers, ropes, or safety equipment.
- No flotation devices in the deep end.
- No one may enter or remain in the pool area during thunderstorms or lightning. The area must be evacuated immediately upon notice.
- The Lazy River is designed for floats only. Floats must remain in the Lazy River area at all times and may not be taken into the main pool.
3.4 Supervision Requirements
| LEGAL NOTICE: The following supervision policies are adopted pursuant to documented safety requirements and are consistent with Fair Housing Act (FHA) guidelines and HUD guidance on permissible safety-based amenity rules. |
Children 13 and Under: Must be accompanied by and remain within reach of their parent or legal guardian at all times while in or around any pool area. For this policy, ‘parent or legal guardian’ means the child’s biological parent, adoptive parent, or court-appointed legal guardian — not a sibling, neighbor, babysitter, or other adult.
Residents Ages 14–17 (Independent Pool Access): Residents ages 14 through 17 may access the pool without their parent physically present only if ALL of the following conditions have been satisfied:
- The parent or legal guardian has submitted a completed and signed Minor Independent Pool Access Authorization Form to the HOA/POA office prior to any independent visit.
- The minor checks in using their resident-linked Digital Access Pass issued through the parent or guardian’s household account.
- The minor carries their resident ID (Digital Pass) at all times while in the amenity area and presents it upon request by Ambassador, Security, Property Management staff or Board.
- No more than three (3) unsupervised minors (ages 14–17) per household may be present in the pool area at the same time without a parent or guardian present.
Non-Swimmers: Any resident or guest who cannot demonstrate basic swimming competency must wear an approved personal flotation device (PFD) at all times while in or around the pool. Parents and guardians must actively supervise non-swimmers without exception.
3.5 Pool Hours for Minors Without a Parent Present
Residents ages 14–17 who have been authorized for independent pool access (per Section 3.4) may only do so during the hours of 10:00 AM – 7:00 PM. These hours are established to ensure adequate lighting, visibility, and staffing conditions for the safety of all users.
3.6 Food, Beverage & Items Policy
- No food or beverages are permitted in or immediately around the pool area. Food and beverages may only be consumed at the Pavilion Area and at the designated area with tables and chair next to the Pavilion.
- All litter must be properly disposed of in trash containers before leaving any seating area.
- Absolutely no alcoholic beverages or controlled substances are permitted anywhere on clubhouse premises unless expressly authorized by the HOA/POA Board.
- No glass containers of any kind are permitted in any pool area.
- No individual speakers or music may be played at the pool area.
- No chewing gum is permitted in the pool area.
3.7 Prohibited Items at the Pool and Pool Area
- Weapons of any type, including any item used with intent to intimidate, harass, or harm.
- Pets of any kind, except pre-approved service animals that must remain on leash and in close proximity to their owner at all times.
- Bicycles, skateboards, rollerblades, hoverboards, or strollers in the pool or gym area.
- Boom boxes or Bluetooth speakers of any kind. Personal earbuds are permitted.
- Water guns, water balloons, or other items deemed disruptive by the Ambassador on duty (exception made with prior approval of board and/or during specific events where added staffing is present).
- Electronic devices within five (5) feet of the pool edge.
- Grills or cook stoves, except during HOA/POA-sponsored social events with prior Board approval.
- Smoking or vaping in any amenity area, including bathrooms.
- No video recording is allowed in and around the pool area without express permission from the HOA/POA (board of directors or property management tem).
3.8 Pool Conduct
- No rowdy, threatening, or disrespectful behavior toward any resident, guest, or staff member.
- No foul, profane, abusive or threatening language. Any individual cited for using language of this nature may face suspension privileges. .
- No public displays of affection beyond brief, appropriate contact.
- No spitting, urinating, or defecating in the pool. Any individual discovered urinating in the pool will be immediately removed from the premises and may face suspension of access privileges.
- No excessive noise that disturbs other pool users.
- No photographing or video recording of any other person in any amenity area without the express written consent of the Board of Directors.
3.9 Facility & Furniture Rules
- No tampering with safety equipment, pool machinery, or any clubhouse property.
- Pool furniture must remain in designated areas and may not be moved into the pool or splash pad areas.
- No blocking of entrances, exits, or walkways.
| SECTION 4 – FITNESS CENTER & GYM RULES |
| SAFETY NOTICE: The Fitness Center contains free weights, weight machines, resistance equipment, treadmills, and motorized equipment that pose documented risks of serious physical injury. All access rules are adopted solely to protect the physical safety of all residents. |
4.1 General Access Requirements
- All residents and guests must present a valid Digital Access Pass upon each entry to the Gym/Fitness Center areas.
- No resident or guest with outstanding dues, fees, or unresolved violations may access the Gym/Fitness Center areas.
- Users assume all risks associated with use of Fitness Center equipment.
- Proper athletic attire is required at all times, including shirts and closed-toe athletic shoes. Bare feet, sandals, and open-toed shoes are prohibited.
- Gym Managers, Monitors, Ambassadors, Security may check the contents of any bags brought inside the gym.
4.2 Minor Access Policy — FHA/HUD-Compliant
| LEGAL NOTICE: The following minor access policies are adopted pursuant to documented equipment safety requirements consistent with Fair Housing Act (FHA) guidelines and HUD guidance on permissible safety-based amenity rules. These policies do not constitute a ban on access by minors. |
Rule 4.2.1 — Mandatory Parental Presence: Residents under the age of 18 may use the Fitness Center ONLY when their parent or legal guardian is physically present and actively supervising them for the entire duration of their visit. The parent or legal guardian must remain inside the Gym/Fitness Center and be able to visibly see the minor at all times during each visit. For purposes of this policy, ‘parent or legal guardian’ means the child’s biological parent, adoptive parent, or court-appointed legal guardian. Siblings, relatives, neighbors, and other adults — regardless of age — do not satisfy this requirement.
Rule 4.2.2 — Mandatory Safety Orientation: Prior to any resident under the age of 18 using the Fitness Center, both the minor and their parent or legal guardian must complete a Gym/Fitness Center Safety Orientation conducted by or on behalf of the HOA/POA. Orientations must be renewed annually. No minor may enter the Fitness Center without documented proof of completed orientation on file with the HOA/POA office.
Rule 4.2.3 — Parental Waiver Requirement: Before any minor may access the Fitness Center , the parent or legal guardian must execute a Minor Fitness Center Access Waiver and Assumption of Risk Agreement with the HOA/POA. This waiver must be signed online and is valid only when signed by the child’s parent or legal guardian of record. Waivers signed by any other adult are not valid.
Rule 4.2.4 — Independent Access Prohibited: Minors under the age of 18 will not be issued an independent Fitness Center access credential. A minor’s Digital Access is linked to their parent or guardian’s household account and will not be activated for Fitness Center entry unless the parent or guardian’s account reflects an active, current Safety Orientation for that minor.
Rule 4.2.5 — Equipment Restrictions for Minors: Residents under the age of 18 are restricted from using free weights exceeding 30 lbs., Olympic or power-lifting platforms, and any other equipment the HOA/POA designates as restricted, regardless of parental presence, unless a written medical clearance from a licensed physician is submitted to the HOA/POA office.
4.3 General Fitness Center Rules
- Please wipe down all equipment with provided sanitizing wipes or solution before and after each use.
- Return all weights, equipment, and accessories to their designated storage locations after use.
- No food or beverages except water in a sealed, non-glass container are permitted.
- No foul language, threatening behavior, or excessive noise.
- Personal earbuds are permitted. Bluetooth speakers are not permitted.
- No photography or video recording of other users without express consent of the HOA/POA.
- Report any equipment malfunctions or safety concerns to an Ambassador or the HOA/POA office immediately.
- No smoking or vaping in the Fitness Center, Bathrooms or surrounding areas.
- Dropping , slamming or abusing any equipment is strictly prohibited.
| SECTION 5 COURTS: BASKETBALL, TENNIS & PICKLEBALL |
5.1 Digital Access Pass — Courts Access
Access to all community courts — Basketball, Tennis, and Pickleball — requires a valid Digital Access Pass and Gate Card to enter. All residents and guests must present their DAP/ Access Pass or verify their credential at the access point before using any court.
5.2 General Court Rules (All Courts)
- Courts are available to residents in good standing and their properly registered guests only.
- Court use is on a first-come, first-served basis. No reservations unless a court reservation system is announced by the Board.
- Players must yield courts to waiting groups after one (1) hour when others are waiting.
- No food on court surfaces. Beverages must be in sealed, non-glass containers.
- No alcoholic beverages or controlled substances.
- No foul or abusive language or threatening behavior.
- No glass containers of any kind.
- No pets on court surfaces except pre-approved service animals.
- No bicycles, skateboards, or rollerblades on court surfaces.
- No smoking or vaping in any court area.
- Proper athletic footwear is required on all court surfaces. Non-marking shoes are required on Tennis and Pickleball courts.
- No tampering with court equipment, nets, fencing, or lighting.
- Shirt and shoes are required at all amenities.
5.3 Supervision of Minors at the Courts
Children Under 14: Must be accompanied by and actively supervised by their parent or legal guardian while using any court facility.
Residents Ages 14–17: May use the courts independently provided the parent or legal guardian has completed a Minor Independent Court Access Authorization Form on file with the HOA/POA.
5.4 Court-Specific Notes
Basketball Court: No hanging on rims or nets. Dunking that causes excessive wear to the equipment may result in access restriction.
Tennis Courts: Tennis play only on designated tennis courts. No pickleball play on tennis courts without Board authorization.
Pickleball Courts: Designated pickleball play only. Proper paddles and pickleball equipment required.

The following conduct standards apply to all community amenity areas without exception and to all residents, guests, and household members regardless of age.
- No rowdy, threatening, intimidating, or disrespectful behavior toward any resident, guest, Ambassador, or HOA/POA representative.
- No foul, profane, or abusive language.
- No public intoxication.
- No weapons of any type. For this policy, a weapon is defined as any object used with intent to harass, intimidate, or harm another person.
- No harassment or discrimination of any kind based on race, color, national origin, sex, religion, disability, familial status, or any other protected characteristic.
- No unauthorized photography or video recording of any person in any amenity area without their express consent.
- No littering. All trash must be disposed of in designated containers before leaving any amenity area.
- Shirt and shoes are required at all amenities.
| SECTION 6 – GENERAL CONDUCT (ALL AMENITY AREAS) |
The following conduct standards apply to all community amenity areas without exception and to all residents, guests, and household members regardless of age.

| SECTION 7 ENFORCEMENT & DISCIPLINARY ACTIONS |
7.1 Ambassador, Monitor, Property Management Team & Security Authority
Ambassadors, Monitors, Property Management Team and Security are contracted team members who report directly to the Property Management Team and Board of Directors and have full authority to enforce all community and amenity rules. They are authorized to:
- Request identification and verify Digital Access Pass credentials for any individual in any amenity area.
- Issue verbal warnings for rule violations.
- Remove any individual from an amenity area for violation of any rule in this policy.
- Document incidents and report violations to the Board of Directors.
Failure to comply with a reasonable request from an Ambassador constitutes an independent violation subject to separate disciplinary action.
7.2 Progressive Disciplinary Policy
Violations will be addressed through a progressive disciplinary process in accordance with community bylaws, including proper notice and hearing procedures for any fines or suspensions of amenity privileges:

| HOUSEHOLD POLICY: The Board of Directors reserves the right to suspend amenity privileges for an entire household based on the offense of any one household member. Suspensions follow progressive disciplinary procedures outlined in the community bylaws, inclusive of proper notice and hearing rights. |
| SECTION 8 Digital Access PASS: ACCURACY & MISREPRESENTATION POLICY |
All information provided during the Digital Access Pass registration and renewal process must be accurate, truthful, and complete. The Association takes the integrity of its amenity access system seriously to ensure fair and proper use by all eligible members.
8.2 Prohibited Conduct
Submission of false, misleading, incomplete, or fraudulent information during the pass application or registration process is strictly prohibited and constitutes a violation of Association rules. Prohibited conduct includes but is not limited to:
- Falsifying residency status or home address information.
- Misrepresenting household size or resident status.
- Providing incorrect ownership or rental tenancy information.
- Attempting to register ineligible individuals as household members.
- Using outdated, altered, or inaccurate identification documents.
- Allowing non-residents to use a household Digital Access Pass.
8.3 Penalties & Enforcement
PENALTIES & ENFORCEMENT
Upon discovery that false, misleading, incomplete, or fraudulent information has been submitted during the pass application, registration, or renewal process, the Association may take one or more of the following actions. Any fine, and any suspension of amenity access privileges beyond same-day removal, shall be imposed only after the notice-and-hearing procedure required by Bylaws Section 3.21 has been completed (see the Enforcement Procedure note in Section 7):
- Suspend the affected household’s amenity access privileges for a stated period, up to the remainder of the season. Any such suspension takes effect only after the Bylaws Section 3.21 procedure has been completed.
- Impose a fine of up to $150.00 per pass for each individual misrepresented on the application. Any fine is assessed in accordance with Bylaws Section 3.21 and, once effective, is applied to the homeowner’s account or invoiced for payment by mail (electronic or postal).
- Require in-person identity verification for all future amenity access requests.
- Extend the length of a suspension for repeat occurrences, subject to the same Bylaws Section 3.21 procedure.
- Refer egregious or repeated misrepresentation to the Association’s legal counsel and, where appropriate, to the proper authorities.
Pending completion of the Section 3.21 procedure, staff and Ambassadors may require in-person identity verification and may remove an individual from an Amenity for the remainder of the day where continued access would be inconsistent with these rules. Same-day removal is an operational measure and does not constitute a fine or a suspension of membership privileges.
8.4 Verification Process
All registration information is subject to verification against Association records, property management databases, and official identification documents. Audits may be conducted at any time throughout the season to ensure compliance. Homeowners may be required to provide documentation such as utility bills, insurance statements, school enrollment records, or other official correspondence confirming residency.
| SECTION 9 POOL & ALL AMENITY USAGE DISCLAIMER & WAIVER OF LIABILITY |
By registering for and using the community pool, gym, courts and all amenities/facilities, the homeowner and all registered household members and guests hereby acknowledge and agree to the following terms and conditions. I am responsible for ensuring that guest attending any amenities/facilities understand all rules and regulations and that they each readthis disclaimer and waiver of liability. This disclaimer is incorporated by reference into the Digital Access Pass registration and is binding upon submission.
9.1 Assumption of Risk
I voluntarily use the pool, gym, courts and all amenity facilities and assume all risks associated with such use, including but not limited to the risk of injury, drowning, illness, or other harm that may occur while using the facilities. I understand that no lifeguard is on duty and that entering the pool area is entirely at my own risk.
9.2 Waiver of Liability
I agree to use the pool, gym, courts and all amenities at my own risk. The Association, its Board members, employees, agents, contracted Ambassadors, and representatives shall not be held liable for any injuries, accidents, illness, or death that may occur as a result of the use of any Amenity or facility.
9.3 Indemnification
I agree to indemnify and hold the Association harmless from any injuries, claims, damages, or liabilities resulting from my use of the pool, gym, courts and all amenities facilities or the use by any person included in my household registration, including guests authorized under my household account.
9.4 Responsibility for Household & Guest Behavior
I am responsible for the behavior of all persons registered under my household and all guests affiliated with my account. I will ensure that all such persons comply with the Association’s amenity rules and regulations at all times.
9.5 Good Standing Requirement
I confirm that I am a member of the Association in good standing with no unpaid fees, outstanding fines, or unresolved violations. I understand that false representation of my standing constitutes grounds for suspension of amenity access privileges, imposed in accordance with the Enforcement Procedure (Bylaws Section 3.21) described in Section 7.
9.6 Rules Compliance
I acknowledge receipt of and agree to abide by all posted pool rules and regulations as set forth in this document. Failure to comply may result in removal from the Amenity for the remainder of the day and may result in suspension of amenity privileges, imposed in accordance with the Enforcement Procedure (Bylaws Section 3.21) described in Section 7.
9.7 Emergency Response
In the case of an emergency, Association staff and Ambassadors may contact emergency services on behalf of individuals present. However, the Association is not responsible for providing medical assistance or emergency care, and does not guarantee the availability of any specific emergency response.
9.8 Property Responsibility
The Association is not responsible for lost, stolen, or damaged personal belongings brought into any amenity area.
